Judge Fern A. Fisher emphasized, in her symposium speech, that unrepresented litigants are often unprepared to face the court, mostly because they are unaware of the procedural steps involved in litigating a case, but also because they face a plethora of cultural, language and socio-economic barriers that impedes them from effectively engaging our legal system. Lawyers need to get involved in making a difference in procedural fairness and actual outcomes, and so does the legal system as a whole by making systematic changes in order to make it more accessible. Judge Fisher suggest that we consider a switch to a more understandable plain language and a simplification of court proceedings, the establishing of the right to counsel in civil cases, the acknowledgement of the socio-economic differences that put some sectors at a disadvantage in the legal system, and the active participation of lawyers; but especially, law students in programs that contribute to the construction of better access to justice for all.

Cita: Fern A.
