California Teachers Association"},"content":{"rendered":"<p style=\"text-align: justify\">La licenciada Karla Monta\u00f1ez Soto recapitula el desarrollo jurisprudencial sobre las cuotas unionales, empezando desde los precedentes del caso doctrinal de <em>Abood v. Detroit Board of Education<\/em> y finalizando con la decisi\u00f3n reciente en <em>Friedrichs v. California Teachers Association<\/em>. Con dicha exploraci\u00f3n, la autora define los siguientes conceptos: los convenios colectivos, el taller cerrado, el taller unionado, el taller agencial y la cl\u00e1usula de mantenimiento de matr\u00edcula. A su vez, Monta\u00f1ez Soto discute el derecho a la libertad de expresi\u00f3n, en su modalidad del derecho a no asociarse, en contraposici\u00f3n con el posible enriquecimiento injusto de empleados no-miembros a los cuales no se les requiera pagar el subsidio, mas sin embargo, de todas maneras puedan recibir los beneficios del trabajo de la uni\u00f3n gracias a la protecci\u00f3n establecida en el National Labor Relations Act. Finalmente, el art\u00edculo trabaja las ramificaciones de una posible revocaci\u00f3n a la doctrina de <em>Abood<\/em> tanto en los Estados Unidos como en Puerto Rico, utilizando como base los argumentos expuestos en el caso de <em>Friedrichs<\/em> y por nuestro Tribunal Supremo en <em>Rivera Schatz v. Colegio de Abogados <\/em><em>PR<\/em>.<\/p>\n<p style=\"text-align: justify\">Karla Monta\u00f1ez Soto, Esq. recapitulates the jurisprudential development of union fees, starting with the seminal case of <em>Abood v. Detroit Board of Education<\/em> and its precedents, and ending with the recent case of <em>Friedrichs v. California Teachers Association<\/em>. With this exploration, the author defines the following concepts: collective bargaining, closed workshop, union workshop, agency workshop and maintenance of membership clause. Furthermore, Monta\u00f1ez Soto discusses freedom of expression, in its freedom to not associate modality, in opposition to the unjust enrichment of non-members unrequired to pay the fees, and who yet, are still able to reap the benefits from the union\u2019s work, due to the protection established by the National Labor Relations Act. Finally, the article addresses the ramifications of a possible reversal of <em>Abood<\/em>\u2019s doctrine, both in the United States and Puerto Rico, based on arguments used in <em>Friedrichs<\/em> and by the Puerto Rico Supreme Court in <em>Rivera Schatz v.
