This was a varied Term in constitutional issues. (1) With a case on the right to lactation at the workplace, the right to privacy acquired an “operative form” and materialized itself as a constitutional litigation weapon. (2) The Court clarified that the power to appoint the Chief Justice of the Supreme Court of Puerto Rico lies within the Governor’s constitutional powers. (3) An important change was made in the standing doctrine: absence of standing will not result in automatic dismissal of the complaint regarding want of jurisdiction. (4) In terms of collateral estoppel doctrine in civil confiscation procedure as part of its relation to a parallel criminal procedure, the Court is divided, particularly regarding the constitutional or statutory nature of said doctrine. (5) The views the judges have in relation to the constitutional rehabilitation mandate vary from understanding it as an actionable right to viewing it as of lesser importance than the victim’s rights. (6) With the expansion of access to judicial procedures by the news media, a debate was held among the judges regarding the challenges it could present in the context of criminal procedures.

Cita: Jorge M.
