Las protecciones al acreedor hipotecario, los procedimientos de ejecuci\u00f3n de hipotecas y la doctrina de la justa compensaci\u00f3n en la expropiaci\u00f3n forzosa son ejemplos que ilustran el modo en el que la <em>comodificaci\u00f3n<\/em> condiciona los an\u00e1lisis jur\u00eddicos sobre la vivienda. La <em>comodificaci\u00f3n<\/em> consiste en la creencia de que cualquier propiedad puede ser reemplazada por su valor de mercado. El autor argumenta que el an\u00e1lisis de valor y mercado no logra considerar los valores subjetivos que representa la vivienda para quien la vive. Por lo tanto, la vivienda no debe ser <em>comodificable<\/em>. Como marco te\u00f3rico, se ampara en la perspectiva de la personalidad, desarrollada por Margaret Radin, que representa un cambio de paradigma en el cual las particularidades de los propietarios, en vez de la naturaleza reemplazable de la propiedad, son los elementos centrales de an\u00e1lisis.<\/p>\n<p>The author identifies an Access to Justice problem in that the real estate proprietary scheme does not consider the subjective values the homeowners ascribe to their homes. The protections for secured creditors, the procedural designs of mortgage foreclosures and the just compensation doctrine on the eminent domain law show how the theory of <em>commodification<\/em> conditions the legal analysis of home. The theory of <em>commodification<\/em> presumes that all property is replaceable by its market value. The author argues that the market value analysis is unable to consider the subjective values the homes represent to those who live them. Therefore, homes should not be <em>commodified<\/em>. As a theoretical framework, the article rests on the personhood perspective, developed by Margaret Radin, which represents a paradigmatic change in which homeowner\u2019s subjective conditions and values \u2014as opposed to the replaceable characteristic of property\u2014 are the central element of the analysis.<\/p>\n<p><strong>Cita:<\/strong> Noel A.
