Su objetivo principal es identificar y resumir el estado de derecho vigente con relaci\u00f3n a las exenciones que se les ha reconocido a las organizaciones religiosas y la extensi\u00f3n de las mismas a organizaciones no religiosas, con el prop\u00f3sito de examinar las implicaciones de tales exenciones ante la aplicaci\u00f3n de las leyes laborables anti-discrimen. Para cumplir con este objetivo, la autora discute la Primera Enmienda de la Constituci\u00f3n de los Estados Unidos con respecto a la Cl\u00e1usula del Establecimiento y la Cl\u00e1usula del Libre Ejercicio de la Religi\u00f3n. Tambi\u00e9n, analiza las exenciones que se han reconocido a trav\u00e9s de la legislaci\u00f3n y jurisprudencia federal, en espec\u00edfico a las organizaciones religiosas. La autora concluye que el cambio de enfoque que se le ha dado en la actualidad a los derechos protegidos por la Cl\u00e1usula de Libre Ejercicio de la Religi\u00f3n dificulta la implementaci\u00f3n de la pol\u00edtica p\u00fablica que promueve la legislaci\u00f3n laboral anti-discrimen con respecto a la protecci\u00f3n de los valores de igualdad y dignidad humana.<\/p>\n<p style=\"text-align: justify\">The author Yobanni D\u00edaz Borrero addresses the controversy about the implications of religious freedom in the application of labor legislation that prohibits discrimination, specifically in the private contractual labor field. Its main objective is to identify and summarize the current rule of law in relation to the exemptions granted to religious organizations and their extension to non-religious organizations in order to examine the implications of such exemptions in the application of anti-discrimination labor laws. To meet this goal, the author discusses the First Amendment of the United States Constitution regarding the Establishment Clause and the Free Exercise of Religion Clause. The author also analyzes the exemptions that have been granted and recognized through federal legislation and jurisprudence, specifically to religious organizations.
