Luego analiza los hechos acontecidos con posterioridad a la ruptura con el r\u00e9gimen tutelar y el reconocimiento de importantes derechos constitucionales en el sistema juvenil estudiando en detalle la decisi\u00f3n de <em>Kent v. US<\/em> y el desarrollo de teor\u00edas sociol\u00f3gicas como la del<em> superdepredador. <\/em>\u00a0Discute las decisiones de <em>Roper v. Simmons<\/em>, <em>Graham v. Florida<\/em>, <em>Miller v. Alabama<\/em> y <em>Montgomery v. Louisiana, <\/em>y las razones que las sustentan para concluir que las renuncias autom\u00e1ticas. Adem\u00e1s, analiza la jurisprudencia de menores en Puerto Rico para demostrar que los factores de la doctrina de capacidad disminuida que deben ser utilizados como atenuantes son utilizados para tratar a los menores como adultos. Luego propone una alternativa ante las graves injusticias que este modelo de traslados ha creado. Esta concluye haciendo una reflexi\u00f3n seg\u00fan lo decidido en el fallo Maldonado de Argentina como un modelo probable de pena para los menores en Puerto Rico.<\/p>\n<p>In this article, professor Iris Rosario Nieves examines the development of the jurisdiction waivers and the doctrine of diminished capacity in the United States and Puerto Rico. The author begins by outlining the rupture that occurred in the United States with the tutelary regime and the movement of the child&#8217;s saviors in the seventies, establishing a parallelism between what happened at that time and the paradigm shift that could be currently occurring through the claim of culpability principle. She then analyzes the events that occurred after the rupture with the tutelary regime and the recognition of important constitutional rights in the juvenile system by studying in detail the decision of <em>Kent v. US<\/em> and the development of sociological theories such as the super-predator. She then discusses the decisions of <em>Roper v. Simmons<\/em>, <em>Graham v. Florida<\/em>, <em>Miller v. Alabama<\/em> and <em>Montgomery v. Louisiana,<\/em> and the reasons behind them. In addition, she analyzes the jurisprudence of minors in Puerto Rico to demonstrate that the factors of the doctrine of diminished capacity that should be used as attenuating factors are used to treat minors as adults. Then she proposes an alternative to the serious injustices that this model of transfers has created. She concludes by making a reflection of the Maldonado ruling of Argentina as a probable model of penalty of minors in Puerto Rico.<\/p>\n<p><strong>Cita:<\/strong> Iris. Y.
