The author explores what he deems a \u201cprocedural conundrum\u201d, that is, where the laws of Puerto Rico do not blend seamlessly with federal common or procedural law. Specifically, the author investigates whether the local concept of succession, or heirship of a hereditary estate, requires the joinder of all heirs to assert a survivorship claim on behalf of the decedent and, if so, how that joinder impacts the federal court\u2019s diversity jurisdiction under 28 U.S.C. \u00a7 1332. Accordingly, the author reviews relevant provisions of Puerto Rico\u2019s Civil Code, common law, and other pertinent aspects of a hereditary succession and contrasts them with the requirements of Rule 19 of Federal Civil Procedure in order to evidence that, in absence of expressions from the First Circuit and the Supreme Court of the United States, the rights of the succession, at least as relating to survivorship claims, can be advanced by some subset of heirs.<\/p>\n<p>En este art\u00edculo, el abogado Tristan Colangelo analiza el alcance de la aplicaci\u00f3n de la Regla 19 de Procedimiento Civil Federal en el contexto de los reclamos sucesorales en nombre de los estados hereditarios en Puerto Rico. El autor explora lo que \u00e9l considera un &#8220;acertijo de procedimiento&#8221;, es decir, donde las leyes de Puerto Rico no se combinan a la perfecci\u00f3n con las leyes federales comunes o procesales. Espec\u00edficamente, el autor investiga si el concepto local de sucesi\u00f3n o heredero de un patrimonio hereditario requiere la uni\u00f3n de todos los herederos para hacer valer un reclamo en nombre del difunto y, de ser as\u00ed, c\u00f3mo afecta esa acumulaci\u00f3n a la jurisdicci\u00f3n de diversidad del tribunal federal bajo 28 USC \u00a7 1332. Como consecuencia, el autor revisa las disposiciones pertinentes del C\u00f3digo Civil de Puerto Rico, el derecho com\u00fan y otros aspectos pertinentes de una sucesi\u00f3n hereditaria y los contrasta con los requisitos de la Regla 19 del Procedimiento Civil Federal para demostrar que, en ausencia de expresiones del Primer Circuito y del Tribunal Supremo de los Estados Unidos, los derechos de la sucesi\u00f3n, al menos en relaci\u00f3n con las reclamaciones sucesorales (o de supervivencia), pueden ser promovidos por un subconjunto de herederos.<\/p>\n<p><strong>Cita:<\/strong>\u00a0Tristan P.
