El artículo explora el rol de la Propiedad Intelectual dentro de un contexto holístico y lo soslaya, como eje fundamental, al desarrollo cultural y social de la humanidad. En particular, este artículo nos introduce a las críticas más comunes que se levantan frente a una concepción restrictiva de la propiedad intelectual. Estas restricciones inciden en todos los niveles del quehacer humano, desde el arte y la creación hasta los derechos humanos y la medicina. Nos señala que esto es así especialmente en tiempos en donde la tecnología ha impulsado nuevas áreas de desarrollo intelectual y colaboración. El artículo luego se enfoca en la práctica en el campo de la Propiedad Intelectual en Puerto Rico mediante cuatro entrevistas a abogados expertos en el área. Reseñando las diferencias en visiones entre los profesores entrevistados, y tomando en cuenta la discusión anterior sobre las críticas comúnmente levantadas en contra del status quo de la Propiedad Intelectual, la autora concluye ofreciéndonos unas reflexiones sobre el futuro de la Propiedad Intelectual.
The article explores the role of Intellectual Property holistically and as a fundamental cornerstone in the cultural and social development of humanity. Particularly, this article introduces the reader to some of the main critiques levied against Intellectual Property. Intellectual Property is typically construed as a restrictive and highly limiting statutory scheme, wherein it directly affects a wide array of human endeavors, from the creative arts to the procurement of fundamental human rights. This is further heightened in our technologically advanced society where new forms of Intellectual Property and collaboration are emerging almost constantly. The article later turns to the opinion of four experts in Intellectual Property law and their experience working within Intellectual Property in Puerto Rico. Highlighting the differences between the four professors, and considering the aforementioned discussion of the main critiques, the author concludes with some interesting predictions as to the future of Intellectual Property.
