La autora Gabriela M. Moros Luces analiza el trato que otorgó el Tribunal Supremo de Puerto Rico a la materia de Procesal Civil durante el término del 2016 al 2017. Específicamente, la autora explora los pronunciamientos del tribunal relacionados con los efectos de una notificación incorrecta de un tribunal a la parte perjudicada en un pleito de desahucio sumario. Asimismo, la autora elabora sobre errores cometidos por abogados y sus consecuencias como no cumplir con un término estricto, no proveer justa causa al incumplir con un término estricto y no notificar a la otra parte sobre un memorando de costas dentro del término jurisdiccional. En segundo lugar, la autora puntualiza respecto a las decisiones del tribunal sobre diversos recursos a saber, la certificación intrajurisdiccional, la sentencia sumaria y el perfeccionamiento de un recurso apelativo que se basa en error de apreciación de la prueba.
Author Gabriela Moros Luces analyses Puerto Rico Supreme Court’s treatment of Civil Procedure during the 2017-2018 term. Specifically, the author examined the Supreme Court’s rulings regarding the consequences of the failure of the court to set bond on the sentencing document for an injured party of a summary eviction and the results of an incorrect notification from the court to an injured party. Then, the author elaborates on the consequences of attorney’s errors such as failing to meet strict terms without providing just cause and failing to notify the other party of a memorandum of costs within its jurisdictional term. Second, the author emphasizes on the Court’s treatment of different court proceedings such as intra-jurisdictional certification, summary judgment and how to properly make an appeal based on an evidence-appreciation error.
