Esta investigación, por el Lcdo. Omar J. Andino, evidencia la evolución histórico-legal del delito de escalamiento en Puerto Rico; ello, desde sus inicios en 1902 hasta el delito que es hoy día. De esta manera, el autor ilustra mediante su escrito cómo se han realizado enmiendas al delito a través del tiempo y particularmente atiende cómo la jurisdicción estadounidense influencia el alcance del delito en nuestra jurisdicción. Con los cambios de administración del gobierno puertorriqueño, se han percibido enmiendas o derogaciones de los Códigos Penales de Puerto Rico, especialmente en las últimas décadas. Al concluir su escrito, el autor expresa ciertas críticas y recomendaciones para con el actual delito de escalamiento, según tipificado por nuestro Código Penal.
This investigation, by attorney Omar J. Andino, evidences the historical and legal evolution of burglary in Puerto Rico from its beginnings in 1902 to the crime that it is today. In this way, the author illustrates how amendments to the typified crime have been made over time. He particularly addresses how the US jurisdiction influences the scope of such crime in our jurisdiction. At the conclusion of his writing, the author expresses certain criticisms and recommendations for the current crime of burglary, as defined by our Criminal Code. He bases these recommendations on a thorough investigation that involves the study of the model Penal Code as well as other U.S. jurisdictions.
